General Terms and Conditions of Sale
1. Scope of Application
These general terms and conditions of sale (GTC) apply to all orders placed on the online store of Fight Right Biel, Chemin des Cordiers 64, 2503 Biel/Bienne ("the club"), as well as to the use of its services. By placing an order, the customer accepts them.
2. Offer
The club offers a paid trial class as well as subscriptions of various durations granting access to classes according to the chosen plan and the current schedule.
3. Conclusion of the Contract
The order placed online constitutes a firm acceptance of the offer. The contract is concluded upon receipt of the order confirmation sent by email.
4. Price and Payment
Prices are in Swiss francs (CHF). Payment is made online at the time of ordering, using the payment methods offered in the store.
5. No Right of Withdrawal
In accordance with Swiss law, there is no right of withdrawal for online purchases. Subject to the provisions below, orders are firm and non-refundable.
6. Trial Class
The trial class is personal and limited to one per person. The date of the class is agreed upon with the club. It can be rescheduled free of charge up to 24 hours before the class; in case of an unannounced absence, the amount remains due. The amount of the trial class is deducted from the price of the first subscription taken.
7. Subscriptions
The subscription is personal and non-transferable. It is concluded for the chosen duration (3, 6, or 12 months) and runs from the date of subscription. The price for the period is payable in advance, in one payment.
At the end of the term, the subscription automatically renews for a period of the same duration, unless canceled. If the customer has registered a payment method, the renewal amount is automatically charged; otherwise, an invoice is sent, payable upon receipt. In case of non-payment within 30 days following the due date, the club may terminate the subscription; amounts related to services already provided remain due. The renewal occurs at the current rate; any price changes are communicated at least 30 days before the due date, with the customer remaining free to cancel by that date.
The subscription can be canceled at any time via the customer portal, effective at the end of the current period. Started periods are not refundable.
8. Suspension
In case of inability to train for at least 21 consecutive days (injury, illness, pregnancy) certified by a medical certificate, the duration of the subscription is extended accordingly, at no cost. No cash refunds are made. Termination for just cause as provided by law remains reserved.
9. Health and insurance
The customer certifies that their health condition allows them to practice combat sports; in case of doubt, a medical opinion is recommended before registration. Insurance (accident, illness, liability) is the customer's responsibility.
10. Liability
The club is liable for damages caused by a serious or intentional fault on its part. Within the limits permitted by law, any other liability is excluded, particularly for lost or stolen items on the premises.
11. Club Rules
The client must respect the coaches' instructions, the internal regulations, and the spirit of respect inherent to the club. In the event of a serious breach, the club may impose exclusion without refund of the remaining period.
12. Schedules and Classes
The club may adjust the schedule, classes, and coaches, and may close during public holidays or communicated vacation periods. The occasional cancellation of a class does not entitle to any refund. If the offer corresponding to the subscribed membership is permanently removed, the club will propose an equivalent solution or a pro-rata refund.
13. Minors
The registration of minors requires the written consent of a legal representative.
14. Photos and Videos
Photos or videos may occasionally be taken during training for club communication purposes. Any client may object by notifying the club.
15. Data Protection
The club processes personal data in accordance with the Federal Data Protection Act (DPA), solely for managing the client relationship. They are not transmitted to third parties for commercial purposes.
16. Modification of the General Terms and Conditions
The club may adapt these General Terms and Conditions. Changes will be communicated to the client and will apply from the next renewal.
17. Applicable Law and Jurisdiction
Swiss law applies. The jurisdiction is in Biel, subject to the mandatory jurisdictions provided by law.
